Changes to Family Friendly employment legislation

There have been a number of changes to legislation recently across a number of areas, and many of these fall under the banner of family friendly related policies.

The right to request Flexible Working rules have been updated with the implementation of the Flexible Working (Amendments) Regulations 2023, which means that this right has become a ‘day one’ right – meaning that there are no continuous service requirements.  Additionally there has been an increase from 1 application per year to 2 applications per year, and other changes include the removal of the requirement for the applicant to explain the impact on the business as well as refusal of the request without consultation.  ACAS have produced a new code of practice on this subject which will be used to benchmark the approaches used

The introduction of unpaid carer’s leave came into force this month under the Carer’s Leave Act 2023 allowing carer’s one week of unpaid leave per year – subject to the correct notification procedures.  This is a ‘day one’ right and the act also includes measures to ensure carers are protected from detriment or discrimination.

The paternity leave regulations have been updated changing the way that paternity leave can be taken.  The Paternity Leave (Amendment) Regulations 2024 mean that paternity leave does not have to be taken in consecutive weeks, and has implemented changes in relation to the notice requirements for requesting leave.
