Employment Law Update

As well as changes to some family friendly employment legislation and statutory rates (both detailed in other TMHRS News),  there have been more updates that employers, organisations and the wider public will need to be aware of.

These include the Protection from Redundancy (Pregnancy and Family Leave) Act 2023 giving extended protection from redundancy for certain groups of people.

We have also seen changes to the requirement to consult collectively in a TUPE situation for smaller organisations, when less than 10 people are affected by the proposed transfer.

Changes have been brought into force in relation to holiday pay and how it is calculated – this only applies to those working irregular hours and where they have at least one week unpaid per year.   Rules around the carry over of annual leave in relation to absence for sickness, maternity, paternity and adoption have also been clarified.

Immigration Legislation has been an area where there has been significant change – and more is planned – especially in relation to the Skills Shortage List, minimum salary levels, dependants of care workers and increases to the Health Surcharge.
