The Working Time Regulations 1998 will be amended to increase the reference period for determining an average week’s pay (for holiday pay purposes) from 12 weeks to 52 weeks. If an employee has worked less than 52 weeks, then employers should use the number of complete weeks worked. This will affect employers who use workers on variable pay.
